The Welfare Due Process Project is actively engaged in defending the civil rights of welfare recipients within the context of public benefits programs. In July of 2000, the WDPP filed a complaint with the United States Department of Health and Human Services Office for Civil Rights alleging discrimination against Native American Aid to Dependent Children/Employment First participants by the Nebraska Department of Health and Human Services Scottsbluff local office. The complaint alleges that Native American ADC recipients did not receive support services provided to non-Native participants, were not provided the same work activity options and non-Native participants, and were sanctioned at a disproportionately higher rate than non-Native participants. This complaint is still pending with the Office of Civil Rights.

In addition, the WDPP works on language access issues for people with Limited English Proficiency (LEP). Participants in welfare programs that have LEP are entitled to receive paperwork and case management services provided in their native language by the Nebraska Department of Health and Human Services. The WDPP has uncovered and resolved language access problems in local offices throughout the state.
